Flex-Y-Plan warrants its products, to the
original owner, to the extent of the purchase price, to be free from
defects in material and workmanship if properly installed, maintained,
serviced and used under normal conditions for their intended purpose, for
as long as the original owner owns the products. Flex-Y-Plan's
obligation under this warranty is limited to correcting without charge or
replacing, at its discretion, all products which it is satisfied were
originally defective. In order to limit this warranty to
manufacturing defects, the following exclusions apply: 1. Products are not
warranted against the effects of normal or abnormal wear and tear.
2. Warranty on moving parts is limited to 10 years of 45 hour per week
usage. 3. Warranty on electrical products is limited to 10
years. Electrical products are not warranted against the effects of
surges or deliberate or accidental overloads. Warranty on electrical
products is void if they are not installed by a licensed
electrician. 4. Light bulbs are warranted for 30 days only. 5.
Warranty on fabric is limited to 10 years. Fabric is not warranted
against any effects of wear. 6. Products are not warranted against
the effects of misuse, negligence or accident, including the effects of
loading the product in excess of the functional load limits of the
ANSI/BIFMA test standards. 7. Products are not warranted when used
in other than a normal office environment, when such non-traditional usage
contributes to the reported problem. 8. Seating is covered by a
separate warranty and is excluded from this warranty. 9. Claims
under this warranty shall be reported to Flex-Y-Plan in writing promptly
as soon as the user becomes aware of any possible defects in any
Flex-Y-Plan product. Claims for shortages or damage present on
delivery, such as scratches or soiling, shall be made within 30 days of
delivery.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED,
INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE. Flex-Y-Plan's liability with respect to its products shall
not exceed that expressly set forth above irrespective of the theory upon
which any claim might be based including breach of contract, warranty,
negligence, or strict liability in torte and under no circumstances shall
Flex-Y-Plan be liable for incidental or consequential damages. No
person, agent or dealer is authorized to give any further warranties on
behalf of Flex-Y-Plan unless such warranty is in writing and signed by an
officer of Flex-Y-Plan. |
